These Terms govern your use of https://skivern.com/ and purchases from ELVESSI, operated by ORION CREATORS INC (“we,” “us,” or “our”). Read these Terms before ordering. When placing an order, you agree to the Terms presented to you at checkout.
Minimum Order Quantity
Each order must contain at least 2 items in total. You may combine different products, colors, and sizes. This is a quantity requirement, not a minimum spend and not a per-product minimum. Eligible returns and statutory rights are not restricted by this order requirement.
1. Eligibility and Accounts
You must be legally able to enter a binding contract to order. If below the legal age of majority where you live, a parent or legal guardian must place the order on your behalf. Provide accurate, current account, billing, and delivery information. Keep account credentials confidential and notify us of suspected unauthorized use.
2. Products and Descriptions
We aim to describe products accurately. Colors may differ depending on display settings. Measurements and fit may vary within reasonable manufacturing tolerances. These variations do not limit rights concerning defective or materially misdescribed products. Products and sizes are subject to availability.
3. Prices and Payment
Prices are in U.S. dollars unless indicated otherwise. Applicable taxes, shipping, and other charges payable to us are shown before order submission. You authorize us and our payment providers to charge your selected method for the displayed total.
Price changes apply to future purchases and do not change accepted orders. Any import duties or customs charges payable by the customer will be disclosed where applicable before purchase. Bank or payment-provider charges are governed by your agreement with that provider.
4. Orders and Acceptance
An order is an offer to purchase. An automated receipt confirms receipt, not acceptance. Acceptance occurs when we send shipment confirmation, unless we expressly confirm acceptance earlier.
Before acceptance, we may decline or cancel orders for unavailable stock, payment failure, suspected fraud, delivery restrictions, or material listing errors. If an error affects your order, we will provide corrected information and let you proceed or cancel. We will not increase charges without your agreement.
If we cancel after collecting payment, we will refund amounts paid for canceled items and related charges refundable under applicable law.
5. Shipping and Delivery
Destinations, charges, processing times, and delivery estimates are described in our Shipping Policy and checkout information. Estimates may be affected by carrier disruptions, customs, or other events. If we cannot ship within the promised timeframe, we will provide notices, cancellation options, and refunds required by applicable law.
Provide a complete, accurate address. Contact us promptly about missing, damaged, or incorrectly delivered orders so we can investigate and arrange an appropriate resolution. These Terms do not remove delivery obligations or applicable consumer rights.
6. Returns, Refunds, and Cancellations
Our Returns & Refunds Policy explains eligibility, return windows, condition requirements, procedures, shipping costs, and refund processing. The policy available when you purchase applies to your order. Mandatory consumer rights take priority over conflicting provisions.
Request cancellation at [email protected] as soon as possible. Cancellation may be unavailable after shipping, but applicable return and statutory cancellation rights remain. Contact us for the prepaid return method and confirmed return address before sending products.
We offer free express shipping to supported destinations and 60-day free returns and exchanges for eligible products, subject to the detailed policies.
7. Promotions
Offers are subject to their stated conditions, including expiration, eligible products, and combination restrictions. We may change or end promotions for future orders without retrospectively removing valid discounts from accepted orders.
8. Acceptable Use
Do not commit fraud, knowingly provide false information, access others’ accounts without authorization, distribute malicious software, interfere with security, infringe legal rights, harass others, submit unlawful content, or collect personal information without authorization. We may restrict access where reasonably necessary to address unlawful conduct, fraud, or security risks.
Sanctions and Export Controls
Orders and website transactions must comply with applicable economic sanctions, export controls, and trade restrictions, including those administered by the U.S. Treasury’s Office of Foreign Assets Control. You must not use the service to conduct prohibited transactions, evade restrictions, or supply goods to prohibited persons or destinations. We may decline, suspend, or cancel transactions where reasonably necessary to comply with these laws. Payments will be handled or refunded as permitted by applicable law.
9. Intellectual Property
Website text, graphics, logos, photographs, and other content belong to us or our licensors and are protected by applicable law. Personal shopping use is permitted. Other copying, distribution, or commercial use requires the relevant rights holder’s permission, except where legally permitted.
10. Reviews and Feedback
Content submitted for publication must be truthful, lawful, and based on your experience. You retain ownership and grant us a non-exclusive, royalty-free license to display and reproduce it in connection with the website and relevant products. Materially different uses require further permission where required by law.
We may remove unlawful, abusive, fraudulent, or irrelevant content. We will not remove a review solely because it expresses an honest negative opinion.
11. Privacy
Our Privacy Policy explains how we handle personal information. Review it before creating an account or purchasing.
12. Availability and Liability
Access may be interrupted for maintenance, technical problems, or events beyond reasonable control. To the extent permitted by law, we are not responsible for indirect or consequential losses arising from website interruptions or misuse.
Nothing excludes or limits liability that cannot legally be excluded or limited, including liability for fraud, willful misconduct, or applicable statutory consumer guarantees. Rights concerning defective products, delivery failures, refunds, and other mandatory protections remain unaffected.
13. Governing Law and Disputes
These Terms are subject to applicable U.S. law and mandatory consumer protections where you live. Contact [email protected] about disputes so we can attempt resolution. This does not prevent you from using courts, regulators, or other remedies available under applicable law.
14. Changes
Updates apply to future use and purchases and will be posted with a revised effective date. Changes will not retrospectively alter existing orders without agreement, except where legally required.
